By accessing or using the NectiqSENSE platform, software, hardware devices, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you ("User") and NectiqSENSE Holdings, LLC ("Company," "we," "us," or "our"). If you are using the Service on behalf of a business, you represent that you have authority to bind that entity.

2. Description of Service

NectiqSENSE provides an IoT-based environmental monitoring platform for monitoring ammonia (NH3) concentration, temperature, humidity, and other environmental conditions. The Service includes hardware devices, a cloud dashboard, data storage, analytics, and alert systems.

The Service is intended for informational and monitoring purposes only and is not a substitute for certified industrial gas detection systems or regulatory compliance monitoring.

3. Account Registration

You are responsible for maintaining the confidentiality of your account credentials and all activities under your account. Notify us immediately of any unauthorized use.

4. Device Registration and Use

By registering a device you agree to use it only for its intended purpose, not tamper with hardware or firmware, comply with wireless communication regulations, and install and maintain the device per the User Manual.

5. Acceptable Use

You may not use the Service to violate laws, transmit false sensor data, gain unauthorized access to other accounts, interfere with the Service, or use it as the sole safety monitor in life-critical applications.

6. Data and Privacy

Your use is also governed by our Privacy Policy. You retain ownership of your sensor data and grant us a limited license to store and process it for the purpose of providing the Service.

7. Important — Limitations of the Monitoring Service

THE NECTIQSENSE PLATFORM IS A MONITORING AND ALERTING TOOL ONLY. IT IS NOT INTENDED TO BE THE SOLE SAFETY MEASURE IN ANY ENVIRONMENT WHERE AMMONIA EXPOSURE IS POSSIBLE. Sensor readings are provided for informational purposes and may not meet OSHA, EPA, or other regulatory accuracy standards. Alert delivery is not guaranteed and depends on cellular and internet connectivity.

8. Intellectual Property

All content, software, firmware, trademarks, and other intellectual property associated with the Service are owned by NectiqSENSE Holdings, LLC. You may not copy, modify, distribute, sell, or lease any part of the Service without written permission.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NECTIQSENSE HOLDINGS, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Governing Law

These Terms are governed by the laws of the State of Colorado, United States. Disputes shall be resolved in the courts of Colorado.
